hay sa wakas natapos na rin ang aking MCLE churva. last Thursday, August 14 was the last day ng aking MCLE sa IBP national headquarters kaya ang next thing to do ay ang mag-ayos ng MCLE complicance report (na natapos ko na kahapon) at ang releasing ng MCLE Certificate.
kanina i went to the Supreme Court to pay 1 thousand pesoses na penalty ko for MCLE non-compliance with the first period of compliance na natapos last April. at ang malas kasi on my way to Padre Faura eh na-sprained na naman ako. waaaa! buti na lang may malapit na drug store nakabili agad ako ng Pau liniment. dapat pupunta pa ako sa IBP Office sa Ortigas to get my MCLE Certificate pero dahil masakit na ang aking left leg eh nag-decide ako na pumunta na lang sa office.
but at least i’m so close to getting my MCLE certificate of compliance. thank God. kasi naman kakaloka ang directive ng Supreme Court sa mga lawyers re: MCLE. to quote:
“Bar Matter No. 1922. Re: Recommendation of the
Mandatory Continuing Legal Education (MCLE) Board to Indicate in All
Pleadings Filed with the Courts the Counsel’s MCLE Certificate of
Compliance or Certificate of Exemption. The Court Resolved to NOTE
the Letter, dated May 2, 2008, of Associate Justice Antonio Eduardo B.
Nachura, Chairperson, Committee on Legal Education and Bar Matters,
informing the Court of the diminishing interest of the members of the
Bar in the MCLE requirement program.The Court further Resolved, upon the recommendation of the Committee on Legal Education and Bar Matters, to REQUIRE practicing members of the bar to INDICATE
in all pleadings filed before the courts or quasi-judicial bodies, the
number and date of issue of their MCLE Certificate of Compliance or
Certificate of Exemption, as may be applicable, for the immediately
preceding compliance period. Failure to disclose the required
information would cause the dismissal of the case and the expunction of
the pleadings from the records.The New Rule shall take effect sixty (60) days after its publication in a newspaper of general circulation.
Oh diva! ang taray ever. kapag walang number ng MCLE Certificate of compliance sa mga pleading dismiss ang case at may kasama pang expunction ng pleadings sa record. grabe!
well, sa isang bar matter ng Supreme Court, they ordered lawyers to:
AM No. 07-6-5-SC, Re: Statement of Contact Details of Parties and Their
Counsels in All Papers and Pleadings Filed with the Supreme Court (July
10, 2007) basically requiring parties and their counsels to indicate in
all their pleadings filed before the Supreme Court their contact
details, e.g., telephone number, fax number, cellular phone number, or
e-mail address. But it’s not required for pleadings filed with lower
courts.
o deva! buti na lang at ang requirement na yan ay for pleadings lang na i-pa-file sa Supreme Court at di kasali ang lower courts.
tungkol naman sa aking MCLE experience, well, medyo may konting ek ek ako kasi i was expecting na we will be updated with the recent jurisprudence pero hindi ganun ang nangyari. well, may ibang lecturers na nag-discuss ng ganun pero most of them ay nagbasa lang ng kanilang lectures. kakaloka din kasi imagine mga kaklase ko sa MCLE eh mga senior lawyers na (meaning senior citizen he he he). nagulat nga ako kasi si atty. venus roxas na lawyer pa ng lola ko nandun din and si atty. jo grapilon na professor ko sa law school at dating IBP president, kaklase at seatmate ko pa, o deva, kaklase ko din si atty, ursua (the famous lawyer sa nicole rape case) at si former CFI judge untalan, among others.
i hope makuha ko na ang aking certificate sa tuesday.
grabe! next month na pala ang bar exams. ilan kaya ang mag-e-exam this year? at ilan naman kaya ang makaka-survive at makakapasa?

Quiet, please, exams ongoing
The Manila City government has banned school groups from holding
“distractive activities” in front of De La Salle University on Taft
Avenue during next month’s bar examinations. Secretary to the mayor
Rafaelito Garayblas said he recalled the permits granted earlier to
groups from schools, including Ateneo de Manila University, University
of Santo Tomas, and even the city government-run Pamantasan ng Lungsod
ng Maynila, upon the request of Supreme Court deputy clerk of court and
bar confidant Ma. Cristina Layusa. “We will close the area in front of
the school to traffic but we will no longer allow anyone to occupy
them,” Garayblas said. In a letter to the owners and operators of
restaurants, eateries, boarding houses and business establishments in
the area, Garayblas asked them to refrain “from allowing school groups,
fraternities and those involved in the bar operations from holding
activities and gatherings, partying, playing loud music and engaging in
drinking sprees” in front of their establishments or parking spaces. Allison W. Lopez
