Belat! Sabi ng Supreme Court ang Executive Order No. 464 ni GMA "partly void". Hala! Na-karma ang lola. Sa desisyon ng highest court in the land na sinulat ni Associate Justice Conchita Carpio Morales, it has upheld ang karapatan ng Kongreso na i-compel ang appearance ng mga executive officials sa mga congressional inquiries na in aid of legislation. Pero sabi naman ng SC "constitutional" naman daw ang EO 464 insofar as it bans executive officials from appearing during question hour.Okey fine!

Teka lang, ano ba ang difference ng congressional inquiries in aid of legislation at question hour? Syempre sinagot din yan ng decision. Sabi ng SC, ang congressional investigation daw in aid of legislation ay di puwedeng basta basta na lang limitahan kasi ito ay co-extensive sa power ng Kongreso to legislate. Paano naman nila ma-e-exercise ang kanilang law-making power and everything kung hindi sila makakapag-conduct ng mga inquiries. Aber? Ang investigation naman na related sa question hour ay hindi naman daw direktang may kinalaman sa isang panukalang batas at ang pagtatanong ay naka-focus lamang sa congressional oversight na may kinalaman sa pagpapatupad ng batas kaya "void" daw ang provision na itesh.

Ayon sa EO 464, ang mga heads ng Executive branch ay required na manghingi muna ng "prior consent" o permiso kay Pres. GMA bago may-i-appear sa isang inquiry ng either House of Representatives o Senado at pursuant daw ito sa Art. VI, Sec. 22 ng ating Constitution. Sabi ng SC hindi valid ang Section 2 (b). Ang reason? eto and i quote (naks)..

"The infirm provisions of EO 464 allow the executive branch to evade congressional requests for information without need of clearly asserting a right to do so and/or proferring its reasons therefor. By the mere expedient of invoking said provisions, the power of the Congress to conduct inquiries in the aid of legislation is frustrated".

O devah, taray! Sabi pa ng SC ang president lang daw ang puwedeng mag-invoke ng executive privilege or puwede nyang i-authorize ang kanyang executive secretary ever na i-invoke ang privilege on her behalf pero dapat sabihin ng executive secretary na "By Order of the President" which means na he personally consulted the president. Bongga.

Ang section 3 daw, sabi ng SC na claim for privilege ay invalid daw dahil ito ay so broad as in as to allow even implied claims of privilege by lesser officials. Ang probisyon daw na nag-re-require sa president na ibigay ang kanyang prior consent means only that she may reverse prohibition na nag-e-exists na nga by virtue of EO 464. In effect daw, parang ina-allow na ng presidente na i-authorize ang claims ng executive privilege by mere silence. Sinabi din ng SC as in inemphasize pa na ang claim for privilege ay isang claim of exemption at dahil claim ito from an obligation to  disclose information, it must therefore be asserted. At read this, kailangan daw malaman ng Kongreso from the executive kung bakit ang requested information ay confidential.

Syempre may i sermon din ang decision sa Kongreso. Sabi ng decision, although ang power of legislative inquiry ay masyadong broad as in talaga, it is not unlimited. At take note, to the extent that investigations in aid of legislation are generally conducted in public, any issuance to unduly limit disclosures in such investigations necessarily deprives the people of information which are presumably a matter of public concern. In that sense, EO 464 directly impairs the right of the people to information on matters of public concern.
